The Department of Energy and Climate Change has submitted an appeal to the Supreme Court in an attempt to overturn a High Court ruling that the December 12 feed-in tariff cut deadline was “unlawful.”

The submission to a panel of three Supreme Justices, who will decide if the appeal will be heard, comes just weeks after Government’s defeat in the Court of Appeal. The paperwork was submitted yesterday, two days ahead of the deadline set on January 25.

DECC’s decision to appeal to the Supreme Court prolongs the uncertainty surrounding whether the reduced feed-in tariff rates for solar PV will apply from December 12, 2011 or March 3, 2012.
